Is the second seat which has no back to it safe for babies and kids to sit against?

Babies shouldn't be put in the 2nd seat of the stroller, it's for older kids and toddlers. It's basically just a little bench. My daughter is 5 and she leans against the other seat a little when she sits in the back and it doesn't seem to be a safety problem.
