Content Submission Terms and Conditions

These Content Submission Terms and Conditions were last updated on October 31, 2008.

By submitting video, image, written, audio or other content to Expo (together known as "Content"), or by participating in any active promotion or program of Expo, you (referred to as "Contributor") acknowledge that you have read, understood, and agree to be bound by these Content Submission Terms and Conditions. These terms and conditions are in addition to the Upload Agreement you may execute upon submitting Content to Expo, and Expo's General Terms and Conditions which are incorporated by reference herein. If there is any conflict between the Content Submission Terms and Conditions and the Upload Agreement, the Upload Agreement will govern. If there is any conflict between the Content Submission Terms and Conditions and Expo's General Terms and Conditions, the Content Submission Terms and Conditions will govern. Expo reserves the right to modify, terminate or change the Content Submission Terms and Conditions and any promotion governed by these Terms and Conditions in its entirety, at any time, and for any reason.

1. Current Promotions and Programs

Unless otherwise indicated by Expo, all promotions or programs are subject to cancellation or change at any time in Expo's sole discretion. All previous offers and promotions regarding Content submission will no longer be valid.
Programs defined as "monthly" promotions begin on the 1st of the current month at 12:00am EST and ending on the last day of the current month at 11:59pm EST (the "Program Period"). Expo reserves the right in its sole discretion to offer (or not offer) a similar program next month. You find information on all monthly programs and promotions within the Contribute section of the Site: http://wwww.expotv.com/make.

Expo reserves the right for any reason, in its sole discretion, to disqualify, refuse to pay, not accept, or not publish any Content.

Unless otherwise indicated by ExpoTV, all promotions or programs are subject to cancellation or change at any time in ExpoTV's sole discretion. All previous offers and promotions regarding video reviews are no longer valid.

Expo reserves the right for any reason, in its sole discretion, to disqualify, refuse to pay, not accept, or not publish any Content.

Pay-Per-Play ProgramBeta: To qualify a video view for payment under the Pay Per Play promotion, a video must be played in its entirety. A video play will be determined and recorded by Expo in its sole discretion. Additional restrictions may apply.

Tryology Program: Specific conditions for participation in individual Tryology offers will be communicated at time of invitation by Expo directly to member. Invitation is non-transferable and only valid for the member selected and invited directly by Expo. The member must follow enrollment instructions as specified in each invitation in order to participate. If at any time you determine that you are unable to submit the requested Content for a Tryology offer that you have accepted, (i.e. the Product you receive was damaged in the mail, you do not have access to a camera over the specified time period, you are affiliated with a company that sells or distributes the Product) you must contact Expo immediately at contactus@expotv.com

2. Content Submission Rules

ALL CONTENT MUST REFLECT THE CONTRIBUTOR'S TRUE AND HONEST OPINIONS AND BELIEFS. If Expo determines in its sole discretion that the Content does not reflect the Contributor's honest opinion, Expo reserves the right to temporarily or permanently ban the Contributor from participating in any promotion or program by Expo. In addition, if Expo determines in its sole discretion that the Contributor has not actually used the product in its review, Expo reserves the right to temporarily or permanently ban the Contributor from participating in any promotion or program by Expo.
To eliminate potential bias, Contributors cannot be affiliated with a company that sells, distributes or is otherwise affiliated with the product or service featured in the Content. Contributors cannot be compensated or otherwise personally enriched for creating Content other than by Expo.
Expo, in its sole discretion, may decline to qualify or pay for Content which lacks a reasonable level of consumer information, product demonstration, or does not meet quality standards as determined by Expo.
For Content submitted as a product review, Expo will not reject Content due to an unfavorable opinion expressed in the Content.
Payment amounts, and all terms and conditions are subject to change at any time. Additional restrictions may apply.
Determination of Content qualification for promotion or any other status is within the sole discretion of Expo and all decisions are final. Expo reserves the right to disqualify, refuse to pay, not accept, or not publish any Content for any reason, in its sole discretion. Expo may or may not communicate such reasons for disqualification to contributing member. Any person whose Content has been disqualified may be disqualified from submitting any Content to Expo in the future.
Content may only be submitted by U.S. legal Residents.
All persons appearing in or otherwise included in the Content must be at least 18 years of age. Parents/legal guardians submitting Content may include their children who are at least 13 years old.
Contributors must be 21 years or older to submit Content featuring an alcoholic product.
Unless otherwise noted, Contributors may not submit Content reviewing a product or qualifying for any promotion ("Assignment") for which the Contributor has already submitted Content. Should a Contributor submit Content for qualification more than once for a product review or other Assignment, Expo may permanently ban the Contributor from participating in any further promotion or program by Expo. If Expo approves Content for which the Contributor has already submitted Content, Expo reserves the right to withdraw such approval.
Content must be created solely and expressly for Expo and be the Contributor's original creation.
Employees of Expo (and members of their immediate family and/or those living in the same household) are not eligible for any Expo promotions or programs.

Specifications

Content submitted in video format ("Video") qualifying for payment as a product review must contain product information, product demonstration when applicable and be helpful to consumers as determined solely in the discretion of Expo.
All Videos submitted as a review of a product must provide the product name and model number within the video.
A Contributor should appear in his or her Video so that his or her face is identifiable.
Unless otherwise noted, Videos must be a minimum of approximately 1 minute in length and must be uploaded to the Expo website in one of the following file formats: WMV, MPG, MP4, MOV or AVI.
Videos must not exceed 75MB and must be encoded to a 320x240 pixel window size. Standard video codecs must be used and videos must be shot in landscape format. See the How To page for guidelines on how to make a video.
If any Content includes one or more persons other than the Contributor, the Contributor must obtain appropriate consent from such person(s) authorizing the Contributor to submit the Content in accordance with the Upload Agreement, including but not limited to, Expo's (or any third party authorized by Expo) use of the Content for commercial purposes.
All Content must be in the English language and must be of a satisfactory quality (i.e., brightness, focus, volume) as determined solely in the discretion of Expo.
Videos must not contain any profanity, offensive language, nudity or otherwise objectionable material as determined solely in the discretion of Expo. Videos must not contain anything considered unsafe, dangerous or violent, as determined within Expo's sole discretion.
Videos cannot feature products deemed unsuitable for a broad consumer audience or products for which there lacks a broad consumer interest ("Unqualified Products") as determined solely in the discretion of Expo. Such Unqualified Products may include, but are not limited to: Prescription medicine, firearms or tobacco.
Expo will not decline Videos containing copyrighted materials where the use of such materials constitutes fair use under the U.S. Copyright Laws, such as for commentary and criticism of that specific product. For more information about fair use, click here.
All data requested by Expo, including without limitation, Content data and data about the Contributor, must be accurately and fully completed during the registration and upload process in accordance with the registration instructions.
Expo does not accept mail-in submissions. Submissions by mail will not be returned.

Acknowledgements

Decisions of Expo are final and binding. If Expo accepts your video, please allow 4 weeks for the video to be published on the Site. Expo will not be responsible for any delays in publishing or interruptions in service resulting in lost video plays.
By accepting or allowing you to upload a video to the Site, Expo does not accept any obligation to publish the video on the Site and reserves the right not to use, display or make available to the public the video for any reason in Expo's sole discretion. Expo reserves the right to remove from the Site any previously published video and/or category of videos for any reason and at any time in its sole discretion. If you have a question as to why your video did not publish on the Site or was removed from the Site, please send us an email at contactus@expotv.com.
By submitting content to Expo, Contributors must execute a Upload Agreement, which is incorporated herein by reference, whereby Contributors assign and transfer all rights, title, and interest in the video (including, without limitation, all copyrights, ideas, know-how and techniques in the Video) to Expo as further indicated in that agreement.
Any content submitted to Expo may be used for any purpose by Expo, its agencies or any third party approved by Expo (including product manufacturers or retailers) and may be posted on any media for public viewing, comments and rating. For purposes of clarity, video or other content (or any portions or derivative works) submitted by users may be used on third party websites including ecommerce, video sharing, social network and manufacturer sites and also in manufacturer advertising materials in print, online, television, radio or any other media.
You should not provide any personal contact information (e.g., address, phone number, etc.) of yourself or anyone else in your Content. You should be aware that if you voluntarily disclose personal information, such information can be collected and used by others. As stated in these Terms and Conditions, Expo takes no responsibility for any Content posted by you.
Submission of a video constitutes permission for Expo, its agencies or any third party approved by Expo (including product manufacturers or retailers) to use the Contributor's name, likeness and video, in whole or in part, in connection or not in connection with his or her video, and in accordance with the Privacy Policy, for advertising, promotional, or any other purpose in any media without additional compensation. In addition, within the guidelines of our Privacy Policy, personally identifiable information may also be transmitted to the third parties for their public and private use as it pertains to content used by such third parties.

3. Payment Details

Expo only processes credits and payments via PayPal in U.S. Dollars. Contributors must have a valid PayPal account which may be obtained at the PayPal website and which may be subject to its own restrictions.
Payments are processed monthly and may be subject to PayPal's applicable terms and conditions separate and apart from Expo's terms and conditions. Please allow up to four (4) weeks from the end of the month in which the submission occurred for receipt of a PayPal payment for qualifying videos. Members will not be entitled to receive interest on any credits or payments.
Valid credits earned from the Pay-Per-Play and Refer-A-Friend programs will be posted to the Earnings section of your My Profile page. A summary of expected credits can be found on the Earnings section of the My Profile page on ExpoTV.com. All credits earned by members are subject to review and change. Necessary adjustments may be applied to member accounts at any time by Expo in its sole discretion.
Contributors are responsible for keeping their Expo account information current and correct in order to facilitate payment to PayPal. Contributors must provide a valid email address when creating a Membership account with Expo. Expo is not responsible for incomplete or inactive email addresses as submitted by a Contributor. Expo is not responsible for misdirected or unredeemed PayPal payments. In the event that a Contributor's information is outdated or invalid at the time of payment, the Contributor forfeits all accrued credits.
Expo, in its sole discretion, may terminate a Contributor's password, account or use of or access to the Pay-Per-Play or Refer-A-Friend programs for any reason. If Expo terminates a Contributor's participation in the Pay-Per-Play or Refer-A-Friend program, any accrued but unpaid earnings will immediately be considered null and void. In this event, Expo will not be responsible to the Contributor or any third party for any termination of the Contributor's access to the Pay-Per-Play program.
No substitution or transfer of a PayPal payment is permitted without the written authorization of Expo. Expo reserves the right to substitute PayPal payment for items of equal or greater value in the event that the PayPal payment is unavailable.
All federal, state and local taxes for any payments received by a Contributor, if any, are the sole responsibility of the Contributor. Void where prohibited. Contributors should be aware that Expo will issue Form 1099s to Contributors who receive compensation in an amount of $600 or greater in value in any given year. Expo hereby, specifically, declines to offer any tax advice to Contributors.

4. Videopinions Terms of Service

Expo is not responsible for the failed submission of Content to Expo for any reason, including without limitation technical failure by Expo (e.g., browser time-out, server failure, etc.). Expo is not responsible for technical failure of any kind to a Contributor or anyone else's computer due to participation in an Expo promotion or program.
Any Contributor who uploads Content without complying with these Content Submission Terms and Conditions or who submits Content under fraudulent or harmful circumstances may be disqualified from this and any future promotion or program as well as be pursued for other legal remedies.
