OFFICIAL RULES. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. OPEN TO LEGAL U.S. RESIDENTS WHO ARE 18 YEARS OF AGE OR OLDER AND/OR PARENTS/LEGAL GUARDIANS, ENTERING ON BEHALF OF THEIR CHILD, 13 TO 17 YEARS OF AGE, AS OF DATE OF ENTRY.
1. PROMOTION TIMING: Contest begins December 4, 2007 and ends December 31, 2007. VOID WHERE PROHIBITED BY LAW.
2. HERE'S HOW IT WORKS: Beginning 12:00 p.m. ET on December 4, 2007 through 11:59:59 p.m. ET on December 31, 2007 ("Submission Period"), submit a video entry that focuses on the winter holiday theme (such as Christmas, Chanukah and Kwanza) within one of the following categories: (a) recipe(s); (b) caroling; (c) decorations; (d) worst gifts; or (e) helpful tips (the "Holiday Video" or "Video"), and you will automatically be entered into the Contest. The Holiday Video must comply with the Videopinions Terms & Conditions, except for the provisions relating to payment (which can be found at: http://www.expotv.com/legal/terms_conditions#videopinions Expotv.com website (the "Website")). The Holiday Video is not required to show a product and is not eligible for any up front payment. The Holiday Video is, however, eligible for the pay-per-play rewards as described in the Videopinions Terms and Conditions. Sponsor is not responsible for lost, late, incomplete or entries not received for any reason. Duplicate entries are prohibited
Important Information for all Entries: Entrants may submit as many different Holiday Videos during the Submission Period as they so choose. Each Holiday Video must be at least one minute in length, must be unique and must focus on the winter holiday theme (such as Christmas, Chanukah and Kwanza) within one of the following categories: (a) recipe(s); (b) caroling; (c) decorations; (d) worst gifts; or (e) helpful tips. Videos must be submitted electronically in the format indicated on the Website and all videos must meet the requirements of the Videopinions Terms & Conditions that are posted on the Website (except for the provisions relating to payment). Any Video that is not of satisfactory quality (i.e. brightness, focus, volume) to be streamed online may be disqualified, at Sponsor's sole discretion. Sponsor has the sole discretion to determine whether a Video qualifies as a winter holiday theme within one of the aforementioned categories listed herein. Any entry not in compliance with the Official Rules and the Videopinions Terms & Conditions posted on the Website will be disqualified. All entries must be the sole, original work of the entrant. Posting may not be immediate; there may be a short period of time between Video submission and posting. Any Video deemed unsuitable for posting, in Sponsor's sole discretion (whether or not it may be eligible) may not be posted on the Website. Sponsor may disqualify previously published Videopinions reviews or those that have won previous awards or competitions. Each entrant certifies that he/she or his/her child is the person depicted in the Video and grants to Sponsor the right to use, publish, and broadcast his/her or his/her child's name, voice, picture, portrait, image and likeness in all media and types of advertising and promotion. Any entry deemed unsuitable will be disqualified in Sponsor's sole discretion. Entrants acknowledge that they (on behalf of themselves or their child) irrevocably assign, transfer and convey the entire ownership, right, title, and interest in the Video (including, without limitation, all copyrights, ideas, know-how and techniques in the Video) to Sponsor. Accordingly, Sponsor will have ownership of and copyright in the Video and consequently by entrant's transfer of ownership of the Video to Sponsor, entrants (on behalf of themselves or their child) hereby grant to Sponsor a limited, non-transferable license, to use, reproduce and edit the Video solely for Sponsor's use. Notwithstanding the foregoing limited license, Sponsor retains the exclusive ownership of the Video.
3. JUDGING: All eligible Videos will be judged, by a panel of judges from Sponsor based on the following criteria: 40% Video quality; 40% entertainment value; and 20% Video content, to determine the five Grand Prize winners. The highest five scores will be the winners. In the event of a tie during the Grand Prize judging process, tied Videos will be rejudged based solely on entertainment value. All Videos must be original and previously unpublished. Decisions of judges are final with respect to all matters relating to this Contest.
4. ELIGIBILITY: This Contest is only open to legal U.S. residents who are at least 18 years of age or older and/or parents or legal guardians, entering on behalf of their child, 13 to 17 years of age, as of date of entry. Employees and families of Expo Communications, Inc. ("Sponsor"), their subsidiaries, divisions, affiliates and related companies, advertising and Contest agencies, and their immediate families are ineligible. If there is a product or service featured in your Video, you (or your child you are entering on behalf of) must not be affiliated with the company that sells the product or service featured in your Video nor can you/your child be compensated in any way for featuring the product or service in your Video. Void where prohibited by law. All United States federal, state, and local laws and regulations apply.
5. PRIZE AND APPROXIMATE RETAIL VALUE ("ARV"): (5) Grand Prize Packages, each consisting of the following: a Net Jet, i-Dog Amp'd and an i-List Music Party. Approximate retail value of each package: $80. Hasbro, Inc. is not affiliated with this Contest or with Sponsor in any way. All other expenses not specified herein are the responsibility of the winner. Prize is not transferable; no substitutions or cash equivalents are allowed except by Sponsor who reserves the right to award a prize (or portion of prize) of equal or greater value if the advertised prize (or portion of prize) is unavailable or if, for any reason beyond Sponsor's control, the stated prize is unable to be awarded. Grand Prize winners will be notified by mail, email or phone, at Sponsor's discretion. Return of prize/prize notification as undeliverable may result in disqualification and alternate winner determination. All applicable taxes related to the prize are the sole responsibility of the individual winner. Sponsor assumes no responsibility or liability, for damages, losses or injury resulting from acceptance or use of any prize.
6. CONDITIONS OF PARTICIPATION: Winner may forfeit prize if Sponsor is unable to contact him or her within 7 days of first attempted notification. IN such event, the prize may be awarded to an alternate winner. The prize is awarded without warranty of any kind from Sponsor, express or implied, without limitation. Entrants agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Contest. Acceptance of the prize constitutes permission for Sponsor and its agencies to use winner's name and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law. By entering the Contest, each entrant agrees to hold Sponsor, its respective directors, officers, employees and assigns harmless for any injury or damage caused or claimed to be caused by participation in the Contest or acceptance or use of the prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize.
7. INTERNET: Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Sponsor reserves the right, but not the obligation, to select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by a participant to deliberately damage any Web site or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such participant to the fullest extent of the law.
8. GOVERNING LAW: Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the state of New York, without regard to conflicts of law. All suits or claims brought in connection with this Contest must be brought in a state or federal court in New York, NY.
9. WINNER'S LIST: For winners' names, send a separate self-addressed, stamped envelope to Expo Communications, 15 W. 18th St., 10th Floor, New York, NY 10011. All requests must be received by January 15, 2008.
